auto transmission whine and low torque

auto transmission whine and low torque
hi I'm posting to see if anyone has heard of these symptoms
2008 Jeep Rubicon Unlimited Automatic transmission 93000 kms
problem:
1. constant and loud whine coming from transmission/ transfer case area passenger side (not engine or belts)
2. loudest at 500 to 2500-3000 RPM
3. whine in D R 2 and 1 gears even when not driving vehicle (parked)
4. no issues when in Parked or neutral gears
5. noise less noticeable or stops after 3000 rpm when driving
6 lacking torque when in low rpm rpm or moving from stopped ( very noticeable)
7. 2wd or 4x4 same issue
started when driving normally after red light noticed the whine and lack of torque, scared me a bit haha.. oh this sound expensive fix,
Then I was parked in a parking lot with a slight slop and had to reverse out and my jeep barley made it out of the 10 feet long slightly sloped parking spot.
I checked the transmission oil and it was a bit low so I filled it up but didn't resole it.
if anyone has any idea of where to start I would appreciate it.

The first question is: Did you check the fluid level with the transmission warmed up, and the engine idling in park or neutral?
Has the transmission been overheated in the past?
Has the fluid/filter ever been changed?
How does the fluid on the dip stick look and smell?

checked the fluid when it was in neutral and warmed up
color was red with a bit of darkness to it (brown)
It did not smell very strong or out of the ordinary
last time transmission fluid changed was at 45000 km but not the filter pan.
not sure about the gas pump, is it on the gas pump in the front end of the gas tank near the transmission ?
ill go change the transmission fluid and filter though see if that helps.
