Pretty sure that if he had engaged his parking brake (E-Brake) this wouldn't have happened either.

Most people who drive a Auto don't pull the E-brake they think putting it in park will lock the transmission. I bet people who live in San Fransisco do though....lol..... Shoot If I lived there I'd have some wheel chocks.

From what I've read it's not because the vehicle is coming out of park, it is because the vehicle was not actually put into park. The shifter returns to its resting position after a shift rather than remain where you put it. So at a glance the shifter is always in the same position so it can be missed that it is not actually in park.

I always pull up my e-brake even when driving automatic. Heck I do it in every vehicle I drive.
