But cut the county some slack....If you read the official comments it looks like the county is trying to protect the integrity of the trail.
Maybe, the County is trying to keep the Rubicon Trail open by making sure the actual original trail (the official county road easement) is followed to avoid legal filings by anti OHV groups who can claim the bypass is not on the official historic trail.
If the bypass was closed and the current Little Sluice was the only way up the trail, how many OHVs would be able to travel the trail? (answer: not many but the few hard core trail rigs)
If you have a trail with little use, the anti OHV groups can get them closed easier.
So, the county has to make the Little Sluice passable by most OHVs to keep the trail user numbers up to avoid closure efforts. The bypass probably was an unauthorized trail not in the 'right of way' of the historic original trail.
If the Rubicon Trail was closed, or only limited to the more extreme trail rigs, there would be a big economic impact to the county & surrounding communities.
Lastly, since the trail was artificially altered to make it harder, then the trail should be put back in its original state.
It may be argued that the artificially altered & harder Little Sluice is not part of the original Rubicon Trail so just because your rig can make up it, you still haven't 'done' the Rubicon trail.
