Default 3rd brake light

Getting ready to install my new RR rear bumper and tire mount this weekend. Is the 3rd brake light mandatory? I'm in Missouri. I'm wondering why it just can't be deleted.

It is a manufacturer installed safety item. It does have to be there. See page 28:

Guys, If you were to remove the exisitng tire carrier and buy one of those brake lights that insert into your hitch and plug into the hitch plug, would this be considered a 3rd brake light?
