MBRP Exhaust with offroad tail pipe
To answer seriously, and this goes for all exhausts:
You only have to worry if
1) The outlet is fully submerged, AND
2) You shut your engine off at that time.
Even then, you may or may not have any damage to the cats, headers, or motor; and probably have other issues to worry about.

It would actually be harder to get water in your exhaust with a downward facing tail pipe because if the exhaust is properly sealed there is no way for the air to escape if submerged in water. If you stick a glass in a tub of water and hold it upside down it will not let any water in and will hold all the air inside, whereas if it is parallel to the ground water can enter with no restriction. This only matters if for some reason your engine is turned off while the exhaust is submerged as Alec said.
