No I don't think they wouldbe liable due to the fact you are changing the Oem configurations.

I will ask today on what options they change. if it's a tire size and gear ratio or if they due change something else.

Thread is dead.

I spoke to the dealership today and they confirmed that they can flash for gears and tires seperately they also confirmed that the new system uses the wheel speed sensors to help calculate. I was told if the output shaft speed and the wheel sensor speed are off in the preprogramed range it sets off the ESP really bad.
They had a commander that someone tried what I thought and it completely through the ESP out of whack. Oh well back to waiting for a programmer.

what is the service center able to do. I have and X with the 16"s. Am I only able to go up to the 32"s and have no worries? If I go taller than I assume all safety, reliability, etc. liability?

So long it is a combination of factory available gears and tires they can flash it. They have flashed my X with 3.21 gears and Rubi wheel/tires.

Should I tell them what to flash for or is that something they should know or have a DC approved calculator to figure it out?

No I would tell them and double check what you have with one of the RPM calculators online. Turns out the first time they did it my speedo was off by 5mph. Just to let you know this is still new to them and my jeep has been in the shop for the last 3 days for an air bag light. Turns out the first time they flashed it screwed up the airbag software, took them a few days to figure it out. All in needed was a reflash of the airbag software.
