Default Abandoned and Unsightly?

So a friend of mine has been working on his Jeep a better part of a month now. There have been a few us helping install a 4" long arm kit and now we are working on other parts. It is parked outside in a driveway and does not even come close to the side walk. Currently it is drivable, with the exception it has neither front or rear bumpers on it. Yesterday a police officer came by and said that it had to move because it looks abandoned and unsightly. We asked if we could just put a tarp on it and he said no. He said we have 30 days to get rid of it.

Long story short I was wondering if someone could point me to the actuall law in regards to this.

Good question. I used to live on the boarder between Escondido and San Marcos and in SM you could be ticketed like you mentioned but in Escondido it was okay so I'm wondering if the laws differ between local cities within the county.

We need SGT, POORDAD or 08redJKnCA to chime in

Sounds like he just needs to drive it. So find out who filed the complaint and go park it in front of their house becuase legally it's moved and is driveable so they have no bases for complaint.

The cop said to move it and just what he needs to do, prove that it's not "inoberable". Beat up and ugly doesn't mean inoperable.

Good information but how does this apply to ones driveway?

EXACTLY AS STATED ABOVE....

If the vehicle is on ones property or driveway, it is generally a local city or county ordinance, which means it varies from city to city and county to county. These then are usually NOT enforced by the Police, but the local Code Enforcement Officers. (although they will bring the Police as Back up, and the police also have the right to enforce these ordinance, its just usually code enforcements job.) They will take pictures, write a report, give the warnings, tag the vehicle, start sending letters, and have the city attorney involved. after about 30 days, sometimes shorter and sometimes longer, depending on the ordinance (Or how good the city attorney is), and city/county, they will come back and remove the vehicle from the property if it is not moved or fixed per the ordinance. So call your local Code Enforcement and they will explain the ordinance and how much time you have and exactly what you are violating.

Kupost: Does your friend live in a developement or are they under a Home Owners Association? Worst case scenario would be they rent in an association. Then they would have very little visibility or knowledge of the CCRs.

The rules vary by community. Some Associations don't even allow you to park overnight in your own driveway. It is either in the garage or in the visitor lot down the block.

I knew SGT would have the answer!

Vern's right about the community & CC&R thing cuz my parent's live in one of those communities and they can't park in their own driveway at night...car has to be in the garage.

In this case there is no HOA. It is in one of the older parts in Clairmont. I think the neighbors just called it in.
