Should there be any up and down play?

You should be under the basic warranty if under 36 months. If you've got oversized tires/wheel spacers/other-than-OEM wheel offset, dealer may argue it was caused by the mods (and probably be right since had you left it stock they would have waited until 36,001 miles to fail, LOL). You just need to take it in and take your chances. The experience of others in your area with various dealers may be informative. You might ask in the sub-forum for your area. To be honest, if you can do your own work, get a set of Synergy BJs and be done with it.

There is a wear tolerance, which can be felt during testing. Measure yours to avoid changing them too soon, unless you just want better ball joints.
Mine were fine throughout the wear limit; finally changed them when they reached 0.050" vertical play, at about 76,000 miles.

Yeah I was told they are within specs. I guess I'll have to accept their diagnosis though I think it's incorrect.

I felt and observed a lot of play... By that I mean a gap of about 1/8 of an inch. Between the two highlighted points.
