how to know if it is a 2012 engine?
Maybe he meant to say the engine was replaced in 2012... I doubt a dealership would have changed the engine from what was in it originally. It may be a crate engine (3.8) that was built in 2012. I'd still ask for proof of where and when the work was done, and then check it out for yourself by calling whoever did the work.
I just looked at the ad that was posted, the dip stick on a pentastar is,on the left side of the engine, that one in the picture is on the right. And he clearly states it came from a 2012 Wrangler, so it' either a typo or he's lying his @$$ off!

My guess, it's been in an accident that made it necessary to replace the engine and repair/replace much of the front end. Why do I say that? Because whoever did the work put the "WRANGLER" and "UNLIMITED" decals in the wrong place. Rather than admit to a serious front end accident, he decided to promote the new motor. Just a guess on my part, but I don't trust this. Not a real Rubi either, since the dash instruments are not fake chrome trimmed (which, IMHO, makes them better, but still doesn't change that it doesn't have the really expensive Rubi parts). Run away.
I would run from it. It would be very expensive and not practical to swap a 3.6 engine into a 3.8 vehicle. Either they have mistaken the year of the motor, or they are trying to scam someone...
If there is an oil filer on the bottom, definitely not a 2012. And in that pic, if it was a 2012 with the air intake where it is, I don't know how you would get to the oil filter from the top.
Maybe it's a 3.8, rebuilt in 2012.
