The rear suspension is too weak
I tow a 4x6 box trailer with a tapered nose. I have the headlight adjuster torx handle in the door pocket to add or subtract the right number of turns to the headlights. This drops the lights down from the tops of the telephone poles when any load is in the back of the JK or when the trailer is hitched.
Either a better variable rate spring or air bags in the springs would be helpful. I do lock out OD for anything but flat land with no head wind.

I have towed loads close to 5K with a stock 07 Rubi. For me there was an issue with driving up the big grades along I-70 in Colorado. Even with the 4:10 gearing, there is a little struggle getting up some of the bigger inclines.

FWIW, I've towed the rated max for my 2door.. 2,000lbs in a 5x8 enclosed trailer. The JK handles it FINE in my area of rolling hills. I've got a 6 speed and 4.10's on stock 32's.
As for the strength of the rear hitch... I hang my 250cc MX bike off the hitch on one of those hitch-mounted carriers. The total load is probably up around 250lbs. The hitch and it's mount are quite stout.

I've got a bumper with a claimed hitch rating of 9k lbs; air bags for the springs, and a brake controller. Keeping the headlights level has never been a problem, I also lock out O/D on hills. Any attorneys know where the law is located that sez, you can't tow something heavier than Mfg authorized specs?
