was rear ended on a highway!!!

I wish a quick recovery for your lady friend! For the jeep,, I would take it to a frame alignment guy and see if the frame was bent, or any adjustments thrown out of whack. Good luck.

"My neck and my back! I want $50,000" all joking aside, hope your girl is good, but look into some legal action. Insurance is about piece of mind. Which doesn't sound like you have, don't settle..make sure you get it.

Default no fault

how does a no fault state work? here in PA if someone smacked into me (which, they have) I get my car fixed 100% the way I want.

I also carry full tort so I can make sure I can recover any type of loss.

Do you have pictures of the accident. Also take a look at your rear driveshaft and all control arm mounting points.

That is my question, here, if you get rear ended as described in the post, it is 100% on the other guy and his insurance would have to pay to my satisfaction, the use of my insurance coverage and the cooresponding deductible would not come into play, only if the other driver was un-insured.

well, The beauty about a no fault state. Is nobody really knows until you get screw (exactly as i'm finding out). all medical is covered under the insurance of the vehicle you were physically in during the accident. this is in the case of a hit and run for one example(luckily her car was not drivable by any means so this was not my exact case), so that the insurance doesn't attempt to back out of payment in such case, claiming that the other unknown driver should pay. so that automagically** goes to my insurance. now here is where the fuzziness begins and headaches start. you first file a claim with the other person's insurance if the blame is obvious (such as mine being a rear end accident.) you try and work with that insurance agency but they tend not to return phone calls e-mails, faxes, pages, telecommunication attempts, esp and so forth. so you end up contacting your own insurer to have them deal with it and Then they go after the other insurance agency. (you pay your own deductibles and so forth like it was your fault.) Hopefully after months or years, you get your money/ deductibles back. the kicker is that both insurers seem to not feel liable and therefore play as little part in the entire story as they possibly can. don't get me wrong, my claim agent has been awesome! everyone else from my insurance agency have been difficult at best. any other questions just ask!!!

I may be able to help I was a Body shop manager and insurance adjuster for over 25 years. The responsible party ie her insurance is liable to make you whole after an accident. You can go thru your policy but then you have to abide by your policy that you signed when you got insurance. Going thru her insurance there are no limitations by what you signed since it's not your policy. I would contact there insurance and set up an appointment to have their adjuster inspect the vehicle. Then take the Jeep to your body shop and have them inspect and tear it down (pull off damaged parts to get a complete look at the damage). At this point they will call the adjuster back out for a supplement (additional damages not found on the initial inspection). Her insurance should also pay for a rental vehicle while your car is being repaired. The no fault should only apply to bodily injury and no the property damage. As for the shaking you are experiencing this could be a broken engine or transmission mount, bent frame, exhaust hitting the rear suspension ect.

Same thing happened to me in nj which is no fault. Got rear ended a few yrs ago and clearly other guys fault he admitted to. I ended up with torn spare cover and a small dent in bumper. I told him not to worry about it and although I got his info I didn't file a claim. My wife had some neck pain and ended up getting physical therapy. It went through her regular insurance and then they got the info from us about his insurance and ours. In the end it went through my insurance and the decided it wasn't worth suing his insurance over but if more money they would have.
What I found out about this from my ins. Co. was:
For no fault states if it is clearly the other persons fault auto damage can be submitted directly to other persons insurance. For injuries it always goes through your own insurance first and depending on cost of bills they may go after other persons.

Didn't bother to read all then posts so it may have been covered already. First off sorry about your jeep and your wife that sucks. But on insurance u need to demand 20% of the value of your jeep because that's what you lost from being rear ended. Your resale value just tanked. U need to be compensated for the depreciation. And along with suing for medical you can sue for that as well. Good luck

Get several of your own estimates that include all damage, then call your insurance company again.
