That was true for the 2007 model year, non Rubicons.
Tow package, or automatic, or chosen as an option.

Don't know if it changed mid year, though.

I ordered my '07 Sahara auto (~Feb '07) with the tow pack and I remember when I built it on line it automatically upgraded to 4:10, no lower choice.

When I was ordering my 2011 rubicon it showed the towing package as having the 3.73's. That's why I didn't get the towing package. I wanted to keep the 4.10's. I'm not sure on the other years though.

My 2011 had the 3.73 as a required option with tow package or a stand alone option. Otherwise it was 3.21 for non-rubicons.

If you had ordered the tow package, your Rubicon would have retained the 4.10's.
You can add it yourself for a lot less money, though.

If you do, order the hitch through MOPAR. On it, the nuts are welded to the hitch. I ordered a cheaper one through 4WD and the nuts weren't welded in. You have barely an inch of space to reach up in and attach the nuts and washers, unless you take the bumper apart.

Yea I wasn't sure and the sales guys didn't know. I ordered a hitch and wiring harness for less than 1/2 what the tow package was anyway. Plus I don't have that electronic tow helping nanny thing. I have done my fair share of towing, I didn't want some electronic BS in my way.
