Warning for improper tires?

I don't see how that could hold up in court. The burden of proof in any case lies on the officer. What that means is in order for the officer to give a violation he would have to have proof that the owner of the vehicle in question's speedometer is off due to the tire size and has not been re calibrated. If the officer ask's you are not obligated to answer that question. If you do answer their question it could earn you a ticket that you won't be able to fight in court because you just admitted guilt.

Learn about your rights people. LOTS of Americans fought and died for them.

I did not read all the replies here, but here is an answer for you. Road tires are federally regulated, and are marked accordingly (D.O.T stamps, etc). The police officer has 0 authority to issue tickets like these. If the tires are road legal, there is not a damn thing the cop can do about it. Take it to court and it will be thrown out.

I just moved from Charlotte, NC myself. I never had a problem running 33x12.5x15 Duratracs and they stuck out beyond the fenders. I spent plenty of time around the UNCC area and at The Flying Saucer, so there was no shortage of cops around me.

I'll bet he assumed your speedo was uncorrected and ticketed you for it. I would fight it if you had already reprogramed the tire size, and make sure you arn't paying for a tire citation.

So....I finally talked with the trooper who wrote me the ticket and warning. He said the warning wasn't for anything, that I had to just sign it myself and mail it in. Doesn't make sense to me? More like a waste of a stamp then anything. The part that said "improper tires" was just a section that could be checked, but wasn't. More useless paperwork!!!

Personally, I wouldn't sign and send in anything that you don't understand, warning or not. I would still call the DPS offices and get more clarification.

I'm in Charlotte too and run 33s on my CJ without problem - but that is bc the fender flairs cover them up. It is a state law in NC to have them covered, although rarely enforced. The reason is they do not want to exposed tread kicking up debris on the cars behind them.

However, we are all missing the point. It is a warning. I love warnings- I hate citations. Fight the speeding if you wish, I have a decent lawyer if you need info. But for the tires- its really no biggie.

Also, to those who say call the courthouse, obviously you have not dealt with the Char/Meck court system. It is a worthless waste of our taxpayer money and he would never get a resolution. Even if he showed to court the officer prob wouldn't be there. He does not have to be in this system and the lawyers attending to the processing of the tickets are clueless.
