Default Got hit from a guy running red light....

Hey guys, so some guy ran a red light and hit my 09 JKR . he hit dead on the lug bolts. on my rear end axial. the trac bar is ripped off the frame. the housing looks bent as well. My axial also moved about 4 inches to the passanger side.contral arms are alittle bent but will need to be fixed. But i am here to ask you guys what i should do about my $2k in add on parts and things. should i remove all of it now befor they look over the car or leve it on and claim it.

Depending on your insurance, they should cover aftermarket parts. Obviously the other party's insurance will have to pay, but your insurance should fight them for the costs to cover everything damaged including any aftermarket parts as well.

If it was the other guys fault, it shouldn't matter. His insurance should pay for everything, regardless of aftermarket parts. If they try to refuse, sue them.

If it was YOUR fault, your insurance may not cover the aftermarket parts. It's why I switched to USAA from Allstate. Allstate covers nothing. USAA will cover up to $5K in aftermarket parts as long as you have a receipt proving cost and ownership. If you try and remove the parts, etc., to "fool" your insurance company, now you're talking insurance fraud, which is a felony in most states. No thanks. I'd rather take my lumps and move on.

Leave it on and claim it. As already said, his insurance is on the hook for it. Make them pay for every scratched bracket and bent bolt.

Only possible exception: He doesn't have insurance and your company is going to pay you, then sue him. They may get cranky about those parts. But you'll have to deal with that--they likely have some obscure provision in your policy that limits their liability.

FYI, here in OK, one in four drivers are uninsured. :-(
