Aside from the BB or a 1.5"-2.5" coil lift you can also look into installing either a 1" or 1.25" body lift instead. On my previous '08 JK I was running 33s with a 1"body lift with no rubbing issues...

So the dealership is trying to tell me that my options are:
1. Buy smaller wheels/tires
2. Pay them to install a lift kit (parts and labor)
I told them that they're crazy and expect to be able to have four passengers sit in my car without the tires rubbing and since they sold me the vehicle exactly the way it is, and certified it as a CPO Jeep, they had to make it right. We'll see what they come back with.

If its certified the dealership has to do something. That will most likely include putting stock wheels and tires on it to resolve the issue since certified vehicles are supposed to be basically stock.
You could try to swing buying the parts for the lift and they provide the labor as a compromise.
