Fixing to Lemon LAW my JK need some Input!!!

Default Fixing to Lemon LAW my JK need some Input!!!

Hey guys and gals. I going once again in the AM to have my soft top looked at. This time for it getting soaking wet for the rain here a couple of days ago. I have been back and forth with it for wind noise at the windshield. I have had two header seals put on and also the whole header bar that the hooks are attached to. Still wind noise. The last time the service manager told me to put some rubber vaccum hose of the post where the hooks grab at. Well we did that and the noise is not as bad but then it leaked. I have had the JK in there going on 4 or 5 times now. I should not have to "rig" the top so that there is no wind noise. I am going to try and sit down with the service mngr and the owner of the dealership in the morning if they will.
Here is the delima i guess. Right now I have a 4x2. If I do end up lemon lawing it will they just cut me a check and then I can turn around and buy a 4x4 or will they just replace the vechicle with the exact one I have? I don't really want to go the lawyer route but talked to a guy today that lemon lawed a Dodge PU a couple of years ago and the attonery got the fees court cost and the price of the vechicle out of DC. My buddy was not out one cent.

I went through the Lemon Law with Nissan a few months ago. Be sure to read the lemon law book carefully (they should've given you one when you bought your JK. If not, you can request one from the dealer or look it up online.) The process is fairly simple, but does take some time. You'll first have to write a certified letter to the manufacturer, and also to the BBB. A BBB agent will contact you and the manufacturer and will handle all the correspondence. Be sure to document EVERYTHING. Call Daimler/Chrysler's Arbitration office and be sure to make sure they get everything rolling ASAP. Be sure to get a name, e-mail address, and direct phone number of the Arbitrations specialist with whom you speak. Call daily...in fact, call multiple times daily to bug the crap out of them. You have rights. With my deal with Nissan, the manufacturer forfeited all of their rights because they failed to contact me within 30 days of receipt of the certified letter. Once that happens, the only options they have are to purchase the vehicle back from you OR replace it, whichever one YOU want. Make sure you have the mileage documented at the very first time you took the vehicle in for these problems. That is the mileage at which they will be required to go on for your reimbursement. They will deduct for mileage, but it's not very much. Don't get discouraged...stay on top of everything.

u gotta buy the 4x4 version. itll cost you a few extra grand though.

You have the option of getting a check or taking a replacement vehicle. The replacement does not even have to be a Wrangler.

You are best off taking the replacement and selecting a new Wrangler. They will even special order one for you and have it rush-built. Another nice thing about taking a replacement is it works out better for paying license and registration on it. Lemon laws in most states take this into consideration. Whereas if you take the check you are just starting off from the beginning again. You will have to take care of the difference in cost of the vehicles but they will usually work with you on that as well.

I would recommend staying away from the lawyer and just utilizing the 3rd party that they assign to the case. There are so many laws about this that you do not have much to worry about. they will probably have you deal with a company called Impartial Services Group.

I probably will contact you tommorrow. Your name and maybe even a phone number thru PM. I do have alot of questions. I LOVE my JK and don't want anything else I just want the problem fixed or a new JK. Like I said I am going in tommorrow monrning so I will see what they say. Thanks again.
Also I haven't contacted the attonery yet but my buddy said he just called him told him what was going on and the attorney got on the ball and got everything that they needed for the case.

Well, I hope it works out for the best for you. It sucks that you have to go through the process of the lemon law, but it you end up with a new JK with no leaks AND can get 4x4, I'm sure it will be for the best. Of course, that means you need to take some time off work to get up to Utah to go wheeling.
Don't forget to pull all your mods before Chrysler takes it back. I doubt if they'll give you any credit for those.
Can't beat having a dealer willing to help give you advice either. Good guys over there at Don-a-vee.

I went through this a few years back with a dodge truck. READ the Law! Each state differs some but are primarily the same. You must document the issue at least 3 times within the first year of ownership (or 12k miles). The issue must be stated the same in all 3 cases. If 2 are for noise and the 3rd is a leak then you do not have a case. One of those, you would have had to contact corporate and a factory rep would have had to look at it and make factory recommendations.
On the up side. I did not have any arbitration. Dodge came back and said they would repalce my truck with money or any vehicle I choose. I just had to pay the difference in MSRP's. Good Luck!

I tried to go through the lemon law for a leaky top on a vehicle. It is true that the problem has to happen before a certain mileage and happen a certain amount of times within a time period. My problems fell WELL within the time frames. After the lawyer looked at my 13 receipts I accumulated over 18 months for the same problem. I was told the lemon law only covered stuff that interfered with the usability of the vehicle and the top leaking was considered "breach of warranty" and would not fall under the lemonlaw.

Before I went to a lawyer the manufacturer didn't even want to deal with me, once a lawyer was involve an offer was made IMMEDIATELY. Not really a good offer but an offer non-the-less. No admission of the problem at all... just a settlement to keep it out of court.

From the sound of your story you don't have a lemon Jeep...you've got a lemon service department.
You can take it to any other dealers you want for warranty repairs.
A leak has to be fixed but just wondering...are you sure the wind noise isn't the same as all the other Jeeps have that don't have a problem.
Is it a louder noise than any other Jeep you've owned so that you can make a comparison.
Might be a Jeep thing y.. w......u.......stand?
