How small is to small??

So I know the tires on the jeep have to be the same size, as if one were smaller it would be turning faster causing strain on the diff and t-case.
On a small car if one tire was almost worn out and one was new it would be barely noticable but a worn out 35(true 35") is comparible to a new 33".
now here is my question. I have 285/70r17 all four are evenly worn and rotated every 10k.
this weekend I cut the side wall on one of them and my spare is a 285/70/17 as well but less then half the tread and the others I would say the are more than half. I will measure tomorrow with a tread depth gage.
so is there a rule of thumb as to how many 32nd's difference you can have or a percentagedidiffference???

I've heard from one dealer that 3/32" difference in tread depth is the max otherwise the differential has to work too much (like continuously driving in a circle).
