It's really easy to fix permanently yourself if you want. Write up on this forum somewhere, but you drill out plastic rivets on top & bottom plastic pieces, go to hardware store buy small capscrewa & nuts, then bolt 'em back together & wa la fixed with custom look for under $7.00.

Your profile lists a 2008 JK so I'll have to assume it's used. Factory warranty is long gone for bumper to bumper. Unless the dealer gave you a 30 day bumper to bumper or something else to cover if $40 would seem pretty reasonable to me.
I know it's a bummer to get a new ride only to have something to break the first week but it does happen with used vehicles. I bought my 99 TJ, had it inspected by a top notch mechanic and gave it a good looking over myself. But shortly after I got it it got cold and the crip seal at the top of the radiator started leaking. Turns out that's common on that particular model Jeep. About $150 later I had my DIY radiator change out done, new drive belt and hoses. Just the way the cookie crumbles with used vehicles sometimes.
