Diff cover question
Hmmm never had a problem with gear oil coming out of my breathers before. Either with my TJ or the JK stock or lifted. I will say it is a must to overfill you diff once you lift it and rotate the pinion angle up. That's why the hole is higher than that of a factory cover. Gotta keep them pinion bearings happy ya know!!!!!

If you fill up to the fill hole on an axle that has not been rotated up, you will have gear oil coming out of your breather tube.

Based on the diff cover you show I would agree with you. I guess all in all it would depend on the actual diff cover. I have Cranes on mine and fill plug isn't that high.
it really is about how much that axle can take. If you over fill the axle it will create a pressure inside the axle which will then push it out of the vent tube.
If you have to see for yourself fill those puppies up just keep some cat litter with you to clean up the oil slick.
